Leafy Terms of Use

Leafy is designed for skiers and snowboarders to mark trails, lifts, cafés, safe zones, share routes, and stay connected with friends. By using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Leafy, you confirm that:

• You have read and understood these Terms.
• You agree to comply with all rules and policies described here.
• If you do not agree, you must not use the App.

We may update these Terms at any time. Continued use of Leafy after updates constitutes acceptance of the new Terms.

2. Accounts and User Responsibilities

2.1 Account Creation

• Some features require a Leafy account. You must provide accurate and current information.
• You are responsible for all activity under your account.

2.2 Account Security

• Keep your login credentials secure.
• Notify us immediately if your account is compromised or used without permission.

2.3 User Conduct

• Use the App in a respectful and lawful manner.
• Do not engage in harassment, bullying, spamming, or any activity that disrupts other users.
• Do not attempt to bypass security features, access others’ accounts, or interfere with app functionality.

3. User-Generated Content

3.1 Ownership

• You retain ownership of content you create, including routes, photos, and notes.

3.2 License to Leafy

• By sharing content in the App, you grant Leafy a non-exclusive, worldwide license to display, store, and transmit it within the App for other users to view.

3.3 Responsibility

• You are solely responsible for the content you share. Do not post false, harmful, or illegal content.
• Leafy may remove content that violates these Terms or is otherwise inappropriate.

4. Location and Tracking

• Leafy uses your location to provide navigation, route tracking, and friend connection features.
• You can control location permissions in your device settings.
• While location sharing enhances social and safety features, you are responsible for using this information safely.

5. Prohibited Activities

You agree not to:

• Use Leafy for illegal or unauthorized purposes.
• Copy, modify, or reverse-engineer the App.
• Collect data about other users without consent.
• Transmit harmful, abusive, or misleading content.
• Interfere with the App’s operation or security.

6. Intellectual Property

• All content, graphics, design, software, and trademarks in Leafy are owned by or licensed to Leafy.
• You may not copy, reproduce, distribute, or create derivative works without explicit permission.

7. Safety Disclaimer

• Leafy provides tools for recreational navigation on slopes.
• Trail and location information is for informational purposes only.
• We do not guarantee safety or accuracy of shared routes, lifts, cafés, or other points of interest.
• Users are responsible for their own safety while using the App.

8. Limitation of Liability

• Leafy is provided “as is” and “as available.”
• We are not responsible for any loss, injury, or damage resulting from the use of the App, including errors in location data or user-generated content.
• Your use of the App is at your own risk.

9. Indemnification

You agree to defend, indemnify, and hold harmless Leafy, its affiliates, and partners from any claims, losses, liabilities, or expenses arising from:

• Your violation of these Terms.
• Your content or actions within the App.
• Your use of the App in a manner not authorized by Leafy.

10. Termination and Suspension

• Leafy may suspend or terminate your access if you violate these Terms or engage in harmful behavior.
• You may deactivate or delete your account at any time.
• Termination does not affect rights or liabilities accrued prior to termination.

11. Third-Party Services

• Leafy may include links or integrations with third-party services.
• We are not responsible for third-party content, policies, or practices.
• Use of third-party services is governed by their own terms.

12. Privacy

• Your use of Leafy is subject to our Privacy Policy, which explains how we collect, use, and protect your information.
• By using the App, you agree to the practices described in the Privacy Policy.

13. Changes to the Terms

• We may revise these Terms from time to time.
• Updates will be posted within the App and take effect immediately.
• Continued use after updates means you accept the revised Terms.

14. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the jurisdiction in which Leafy operates, without regard to conflicts of law principles.
• Any disputes will be resolved through informal negotiation where possible, or in the courts of the governing jurisdiction if necessary.
